We adopt a conciliatory approach, but when necessary we defend our clients in judicial and arbitration proceedings.
We regularly advise on trade mark matters, both contentious and contractual. For example, we represented a startup in the defence of its brand in a lawsuit against a technology giant and a multinational group in its brand protection strategy. We also successfully defended the registration of the trade mark of a unicorn ‘made in Barcelona’ after years of litigation in different courts.
We have extensive experience in technology contracting. For example, we advised a Spanish company in the negotiation of a worldwide distribution and resale agreement for its software with an American multinational. For international matters, we have a network of lawyers from other jurisdictions.
We have advised many clients in the negotiation of agency and distribution contracts and have acted in lawsuits for claims for damages arising from the termination of contracts, such as, for example, a fashion company in a cross-border lawsuit to claim for goodwill compensation.
This is one of the areas in which we accumulate more experience, both teaching and practical. We regularly advise production companies, record companies, digital platforms, publishers, writers, artists and performers in the audio-visual and music sector throughout the production and exploitation cycle of a work, including the defence of copyright lawsuits.
We have helped companies to adapt their business to data protection regulations, such as an international franchise group and a consolidated startup in the digital sector. Likewise, we solve queries of differing degrees of complexity in a creative way so that it does not put a brake on our clients’ business.
We have plenty of experience in this field, both from a practical and an educational perspective. We have advised companies from different sectors in disputes relating to unfair advertising, always helping our clients to avoid business losses derived from such anti-competitive practices.
We have advised several companies and agencies on new digital marketing techniques, facilitating its safe implementation without losing leads.
We firmly believe in sustainable technology and are passionate about these projects. For example, we have advised an international group on its investment strategy in intangible assets and we have helped a startup to protect its assets in the FoodTech sector.
We have drafted and negotiated revenue share contracts between strategic partners to create secure frameworks in which to share risks and benefits.
Entrepreneurship advice is another of the firm’s strong points. We have grown up alongside many startups, including a unicorn made in Barcelona. We regularly advise different startups on day-to-day legal issues or investment rounds or exits.
Some clients, especially in-house legal firms with a heavy workload or startups without an in-house legal team, ask us for support to free teams from recurring workloads so they can focus on more strategic issues.
We collaborate with various local and international law firms when they need IP / IT specialists. In the same way, we turn to other firms when our clients need specialised advice that we do not offer.
